Please read these Terms of Use carefully before using this website. By using this website, you indicate your consent to these Terms of Use. If you do not agree to these Terms of Use, please refrain from using the website.

1. Scope of Services and Health Disclaimer

The services and content provided by Energy Gardener®, including but not limited to hypnotherapy, regression therapy, subconscious coaching, guided meditation, self-led hypnosis, energy tools, online group programmes, and transformational retreats, are intended for self-development and informational purposes only. They do not constitute medical, psychological, or psychiatric diagnosis or treatment and are not a substitute for professional clinical care.

You must be at least 18 years of age to access the services provided. These services are not suitable for individuals experiencing severe mental health conditions, including but not limited to active psychosis, suicidal ideation, personality disorders, or untreated trauma involving regular dissociation. If you are under the care of a mental health professional, please consult them before engaging in regression or subconscious therapy.

If you are in crisis, please contact your GP, NHS 111, Samaritans at 116 123, or your local emergency services.

2. Use of the Site

Your access to and use of this website and all related websites operated by Energy Gardener® (including www.energygardener.com and www.energygardener.org) is subject to these Terms of Use and applicable laws. By accessing and using the Site, you accept these Terms without limitation or qualification.

All content, videos, sound recordings, downloadable guides, session materials, text, graphics, and intellectual property ("Content") is the exclusive property of Energy Gardener® and is provided for your personal and informational use only.

You may not:

  • Copy, reproduce, republish, distribute, or publicly display any Content without express written permission

  • Use Content for commercial or teaching purposes unless explicitly licensed

  • Reverse engineer, modify, or create derivative works based on proprietary materials

Any unauthorised use may violate copyright, trademark, or other laws and will result in removal from all Energy Gardener® programmes without refund, in addition to possible legal action.

3. Copyright Protection and Content Theft

Theft or repurposing of Energy Gardener® materials, including coaching models, programme structures, language, visual assets, and proprietary frameworks, is strictly prohibited. All public-facing and client-facing content is protected by copyright and legally notarised through the Protect My Work® programme.

Any commercial use of proprietary content without explicit written permission from Kate Tolson constitutes infringement. If you are found to have used or repurposed any materials or verbal content for commercial gain without permission:

  • Legal action will be taken to sequester any commercial or financial profits gained through unauthorised use

  • You will be removed from all Energy Gardener® programmes and denied further access to content or support

  • You will not be entitled to a refund of any kind

4. AI and Note-Taking

As part of ongoing improvements to service and accuracy, AI software is used within Energy Gardener®, primarily for the purpose of note taking.

Every reasonable effort is made to anonymise personal or identifying data used in AI-supported documentation, but please be aware that full control over third-party processing cannot be guaranteed. If you have concerns about the use of AI tools in documentation, please contact [email protected] prior to booking, and we will explore possible alternatives.

5. Intellectual Property

All trade names, trademarks, and biographical information including Energy Gardener®, Clear to Grow® and Evolve Your Perspective® are protected marks owned by the Company. No right, title, or interest in any intellectual property is transferred to you through use of the Site or services.

6. Communications and Privacy

By using the Site or registering for services, you consent to receive communications related to services, products, and updates. These may be sent electronically via email. Your personal data will be handled in accordance with UK GDPR. Full details are outlined in our Privacy Policy.

Your personal data will never be sold or intentionally shared with third parties except where required by law. You may request access or deletion of your data at any time.

7. No Guarantees or Warranties

Results vary. Any testimonials or case studies represent individual experiences and are not guarantees. By using this Site or its services, you agree to take full personal responsibility for your outcomes and decisions.

The Site and its content are provided "as is" with no warranty of fitness for a particular purpose, accuracy, or continuity of access. The Company disclaims any liability for:

  • Loss of data or damages arising from unauthorised access

  • Technical defects, viruses, or interruptions

  • Reliance on any content shared on the Site

9. Payment and Refund Policy

The Company reserves the right to cancel any live programme, workshop, or group session at its discretion. In the rare event that a cancellation occurs, any refunds issued will be limited strictly to the ticket or participation price originally paid. The Company will not be liable for any additional costs incurred by the participant, such as travel, accommodation, or other expenses.

10. Indemnification

You agree to indemnify and hold harmless Energy Gardener® and its directors, employees, and representatives from any claims, damages, or expenses arising from:

  • Breach of these Terms

  • Use of the Site or services

  • Infringement of any intellectual property or rights

11. Jurisdiction and Legal Venue

These Terms are governed by the laws of England and Wales. By using the Site, you consent to the exclusive jurisdiction of UK courts for any dispute arising from your use of the Site or its services.

12. Additional Disclaimers and Conditions

  • This Site and its services are not intended for individuals under the age of 18. By using this Site, you confirm that you are of legal age to consent to these Terms.

  • This Site does not offer emergency mental health or crisis support. If you are in crisis, please contact appropriate medical or emergency services.
